PROMATIC Orthotics™ User Agreement

Welcome to ProMatic Orthotics™ (“Company”, “we”, “our”, or “us”). By accessing or using our website, products, or services (collectively, the “Services”), you agree to be bound by the following User Agreement (“Agreement”).
If you do not agree with any part of this Agreement, do not access or use our Services.
1. Eligibility
You must be at least 18 years old or have the consent of a parent or legal guardian to use our Services. By using our Services, you represent that you meet these requirements and are legally able to enter into this Agreement.
2. Medical Disclaimer
ProMatic Orthotics™ provides custom sports orthotics based on biomechanical assessment and performance needs. While our products are designed using medically informed methods, they are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult with a qualified healthcare provider regarding medical concerns.
3. Account Creation
You may be required to create an account to use certain Services. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.
4. Orders and Payment
All prices are listed in [USD] and are subject to change without notice. Orders for custom orthotics require full payment at the time of purchase. Refunds, exchanges, and warranty details are governed by our Return Policy.
5. Intellectual Property
All content on the Site—including trademarks (e.g., ProMatic Orthotics™), logos, text, graphics, software, and other materials—is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, modify, distribute, or use our materials without written permission.
6. User Conduct
You agree not to:
- Submit false or misleading information.
- Use the Services for any unlawful purpose.
- Infringe upon our or others’ intellectual property.
- Attempt to disrupt or interfere with our Services.
7. Custom Product Terms
Because orthotics are custom-made to your foot and performance specifications, they are generally not eligible for return unless they are defective. Please carefully review all measurements, fitting appointments, and foot scans.
8. Privacy
We respect your privacy. Your use of our Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.
9. Disclaimer of Warranties
Our Services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the orthotics will meet all performance goals or medical outcomes. Use at your own discretion.
10. Limitation of Liability
To the maximum extent permitted by law, ProMatic Orthotics™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including personal injury or athletic performance issues resulting from the use or misuse of our products.
11. Indemnification
You agree to defend and indemnify ProMatic Orthotics™, its affiliates, and employees from and against any claims, damages, or losses resulting from your use of the Services or violation of this Agreement.
12. Termination
We reserve the right to suspend or terminate your access to the Services at any time, without notice, for any reason, including violation of this Agreement.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
14. Changes to This Agreement
We may update this Agreement from time to time. Continued use of the Services after any modifications constitutes acceptance of the revised terms. Please check this page periodically.
